1. Definitions

• "Service" means the MyAkaun cloud-based accounting and POS SaaS platform accessible via our website and any associated mobile applications.
• "Subscriber" / "You" means the individual or legal entity that has registered for an account and subscribed to any plan.
• "Tenant" means each isolated workspace created under a Subscriber's account.
• "Subscription Plan" means the selected pricing tier that determines the features and resource limits available to you.
• "Data" means all financial records, invoices, contacts, transactions, and other information you upload or create within the Service.

2. Account Registration

You must provide accurate, complete, and current information when registering. You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at support@myakaun.com if you suspect any unauthorised use of your account. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

3. Subscription Plans & Payment

• Subscriptions are billed in advance on a monthly or annual basis, as selected at checkout.
• All fees are stated in Malaysian Ringgit (MYR) unless otherwise indicated and are exclusive of applicable taxes (e.g., SST).
• Payment must be made via the approved payment gateways listed on our pricing page. We currently accept credit/debit cards and online banking.
• Subscriptions auto-renew at the end of each billing cycle unless cancelled at least 24 hours before the renewal date.
• We reserve the right to change pricing with 30 days' written notice via email or in-app notification.
• Failed payments may result in suspension of your account until payment is settled.

4. Free Trial

Where a free trial is offered, it is provided for evaluation purposes only. At the end of the trial period, you must subscribe to a paid plan to continue accessing the Service. We reserve the right to modify or cancel free trial offers at any time without notice.

5. Refund Policy

All subscription fees are non-refundable except where required by applicable law. If you believe you have been charged in error, contact us within 7 days of the charge. Approved refunds will be processed to the original payment method within 14 business days. Please refer to our separate Refund Policy for full details.

6. Acceptable Use

You agree to use the Service only for lawful business purposes. You must not:

• Use the Service to process, store, or transmit any data that violates any law or regulation, including financial fraud or money laundering.
• Attempt to gain unauthorised access to any part of the Service, its servers, or related systems.
• Reverse-engineer, decompile, or disassemble any part of the platform.
• Resell, sublicense, or redistribute access to the Service without our prior written consent.
• Use the Service to send unsolicited commercial communications (spam).
• Upload malicious code, viruses, or any disruptive software.

Violation of this section may result in immediate account termination without refund.

7. Data Ownership & Privacy

You retain full ownership of all Data you submit to the Service. By using the Service, you grant us a limited, non-exclusive licence to host, process, and display your Data solely to provide and improve the Service.

We will never sell your Data to third parties. Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms.

8. Data Security

We implement industry-standard technical and organisational measures to protect your Data, including encryption in transit (TLS) and at rest, regular backups, and access controls. However, no method of transmission over the internet is 100% secure. You are responsible for maintaining the security of your own credentials and for any access to your account.

9. Data Backup & Retention

We perform regular automated backups of platform data. However, you are encouraged to maintain your own copies of critical financial records. Upon termination of your subscription, your Data will be retained for 30 days, after which it may be permanently deleted. You may export your data at any time from within the platform.

10. Service Availability & Uptime

We aim to provide 99.5% monthly uptime, excluding scheduled maintenance windows (communicated at least 24 hours in advance). We are not liable for downtime caused by third-party infrastructure failures, DDoS attacks, or force majeure events. Planned maintenance will be carried out during off-peak hours where possible.

11. Intellectual Property

All software, algorithms, interfaces, trade marks, logos, and content forming part of the Service are the exclusive intellectual property of MyAkaun and its licensors. Nothing in these Terms transfers any intellectual property rights to you. You may not copy, modify, or create derivative works of the platform without prior written permission.

12. Third-Party Integrations

The Service may integrate with third-party services (e.g., payment gateways, email providers, tax APIs). We are not responsible for the availability, accuracy, or conduct of third-party services. Your use of such integrations is subject to the respective third party's own terms and policies.

13. Limitation of Liability

To the fullest extent permitted by law, MyAkaun shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities arising from your use of or inability to use the Service.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the total fees paid by you to us in the 3 months immediately preceding the event giving rise to the claim.

14. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or free of viruses.

Note: The Service is an accounting tool and does not constitute financial, tax, or legal advice. You remain solely responsible for the accuracy of your financial records and compliance with applicable tax and regulatory requirements.

15. Indemnification

You agree to indemnify and hold harmless MyAkaun and its officers, directors, employees, and agents from any claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your use of the Service, your Data, or your breach of these Terms.

16. Termination

Either party may terminate the subscription at any time. You may cancel your account from within the settings panel or by contacting support. We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or if required by law. Upon termination, your right to access the Service ceases immediately.

17. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

19. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Malaysia.
